I think this homicide happened when the victim was walking in a lonely street in the middle of the night and suddenly he met a guy who was hiding himself in the shadows, this person seemed a little disturbed, he was looking at the wall and whispering some words without sense. Then the victim asked him if he needed some help and the guy looked at him with crazy eyes and said that everything was good and that everything will be over soon because he is the chosen one and must eliminate all the trash from the world. In that moment the victim realized that something was wrong with the guy, maybe he was crazy or had a mental disease and in that moment the guy asked to the victim “ are you trash?” then he smelled the air and answered “yes, you are!”. The victim began to move back but the guy grabed him very quickly by the jacket and started to stab him with a knife, a few minutes later the victim died because of the bleeding.
It is very clear that the defendant can be charged for murder because the intention to kill is evident, he wanted to kill him.
But we can´t forget the special mental circumstances of the killer, so the defence may use the argument of diminished responsibility because of the mental state of the defendant at the moment of the killing. Obviously the killer had some kind of mental handicap, his mental state was not normal, and if the defence is a success and manages to prove this situation it is posible to charge him of manslaugther instead of murder.

Mr.Peter Griffin was walking to his home when suddenly a man appeared in front of him. This man was alone in the shadows, saying words without any common sense.
Mr. Griffin was a little scared, but he got closer and asked him if he needed help. The stranger began to shout very loudly, showed a knife and run towards Peter, who tried to walk away, but the attacker grabbed and stabbed him while he was shouting “red ink, I want more red ink!”. Due to the wounds and the lost of blood, Mr. Griffin died.
We are in a clear case of murder by cutting weapon. The accused should pass a lot of years in jail if there weren’t some mitigating circumstances. The defendant lawyer claimed diminished responsibility. He proved that his client hasn’t got a mental state we could consider as normal, so the conviction was reduced to manslaughter.
